Terms of service

These are the terms on which we supply botthms.Ready. They are written to be read rather than survived, and we have tried to say plainly what you are paying for, what the platform does, and what it does not do.

1. Who you are contracting with

botthms.Ready is supplied by botthms Ready (Pty) Ltd, registration number 2021/868401/07, a company registered in South Africa. In these terms "we", "us" and "our" mean that company, and "you" means the individual, school or club that subscribes to the service.

2. What the service is

botthms.Ready is an athlete wellbeing and training-load monitoring platform. Athletes complete a daily check-in, coaches see squad readiness, and the platform calculates measures such as a wellness index, training load, acute-to-chronic workload and monotony from what is entered.

The service is a coaching and monitoring tool. It is not a medical device, it does not diagnose injury or illness, and nothing it produces is medical advice. Scores, flags and readiness bands are prompts for a conversation between an athlete and the people responsible for them. Decisions about training, selection, medical treatment and return to play remain entirely yours, and should involve a suitably qualified medical professional where that is appropriate.

Where GPS, wearable, match-statistics, weigh-in or body-composition data is imported or entered, it is treated as an external data layer that sits alongside the platform. It does not alter the readiness, wellness or load calculations, and any session suggestion shown beside it is advisory only.

3. Plans and fees

Individual subscriptions are R99 per month for one athlete, billed monthly.

School and club subscriptions are R5 000 per month on a 12-month agreement. That fee covers unlimited athletes, coaches, staff and parent accounts for the whole organisation. In addition, a sport-code licence of R5 000 per sport code per year covers onboarding and use of the platform for that code, across every team and age group within it; it is invoiced at activation and renews annually.

Add-on services, including match statistics, GPS data integration, watch connectivity, InBody scans and on-site fitness testing, are not included in the subscription. Match statistics and GPS integration are priced according to the third-party platform and subscription the organisation uses; match statistics can also be supplied by us per match. All add-ons are scoped and quoted separately on the onboarding call and none is required for the platform to work.

The prices shown are the prices payable. We are not currently registered for VAT, so no VAT is added to our invoices. Should we become VAT registered, we will tell you in writing before it affects any invoice.

4. Billing and payment

Individual subscriptions are billed monthly in advance from the date you subscribe.

School and club subscriptions are invoiced monthly in advance unless we agree a different arrangement with you in writing. Sport-code licences are invoiced annually in advance at activation.

Invoices are payable within 30 days. If an invoice remains unpaid for more than 30 days after its due date, we may suspend access to the dashboard after giving you written notice and a reasonable opportunity to settle. We will not delete any data while an account is merely suspended.

5. Term, renewal and cancellation

An individual subscription runs month to month. You can cancel it at any time and it will end at the close of the month you have paid for.

A school or club subscription runs for an initial term of 12 months from the start date. This is deliberate: the platform compares an athlete against his or her own history, and a full season is what makes those comparisons meaningful.

Unless either of us gives written notice at least 30 days before the end of the term, the subscription continues month to month on the same terms until either of us gives 30 days written notice.

Sport-code licence fees are not refundable. If you cancel a 12-month subscription before the end of its term, the balance of the term remains payable, unless we have materially failed to provide the service.

We may end an agreement immediately if the service is used unlawfully, or in a way that puts an athlete safety or personal information at risk.

6. Accounts, athletes and minors

Most athletes on botthms.Ready are children. A school or club must obtain consent from a parent or legal guardian before an athlete under 18 is added, and must be able to demonstrate that consent. The platform records that consent as part of the signup process.

You are responsible for the accounts you create and for keeping login details secure. Tell us promptly if you believe an account has been compromised.

Coaches and staff may only access athletes in their own organisation, and only those they are assigned to. You must not share a login between people, because doing so makes it impossible to tell who viewed or changed a child record.

7. Personal information and POPIA

For school and club subscriptions, the school or club is the responsible party for its athletes personal information under the Protection of Personal Information Act, 2013. We act as the operator, processing that information on your documented instructions and for the purposes of providing the service.

For individual subscriptions, we are the responsible party for the account holder information.

Health-related and biometric information about a child is special personal information under POPIA. We process it only to provide the monitoring service, we do not sell it, and we do not use it for advertising.

We apply reasonable technical and organisational measures to protect personal information, including access controls that keep each organisation data separate from every other organisation. If a security compromise affects your personal information, we will notify you and the Information Regulator as POPIA requires.

Our privacy policy sets out in more detail what we collect, why, and how long we keep it.

8. Your data

The athlete records, check-ins, notes, match statistics, GPS data and results you and your athletes enter or import belong to you. We claim no ownership of them. Data an athlete chooses to share from a connected wearable is the athlete's and is handled as set out in our privacy policy.

You may export your data at any time during the subscription. On request within 60 days of an agreement ending, we will provide a full export in a machine-readable format.

After that period we will delete or anonymise your data, except where we are required by law to retain it. Anonymised, aggregated information that cannot identify any athlete or organisation may be retained to improve the service.

9. Acceptable use

Do not use the service to do anything unlawful, to attempt to access another organisation data, to reverse engineer or copy the platform, or to resell access without our written agreement.

Do not use athlete information for any purpose other than the wellbeing, coaching and development of those athletes. In particular, it must not be used to discriminate against a child or to disclose health information to anyone who has no proper reason to see it.

10. Availability and support

We aim to keep the service available at all times, but we do not guarantee uninterrupted access. Maintenance, third-party outages and factors outside our control can interrupt it, and we will keep any planned interruption as short and as well-signposted as we reasonably can.

Support is provided by email at info@botthms.co.za during ordinary business hours in South Africa. Onboarding and staff training are included in a school or club subscription.

11. Our intellectual property

The platform, its software, its scoring models and the botthms.Ready name and marks remain ours. Subscribing gives you a non-exclusive, non-transferable right to use the service for the duration of your subscription, and nothing more.

12. Limits on our liability

Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, or for fraud.

Subject to that, we are not liable for indirect or consequential loss, for loss of profit or opportunity, or for any decision taken about training, selection, medical treatment or return to play. Those decisions are yours.

Our total liability arising out of the service in any 12-month period is limited to the fees you paid us in that period.

13. Changes to these terms

We may update these terms from time to time. If a change materially affects you, we will give you at least 30 days written notice before it takes effect. Continuing to use the service after that date means you accept the updated terms.

14. Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.

If something goes wrong, tell us first. We would far rather fix it than argue about it.
